Ready or Not: What you Need to Know About
the U.S. DOL’s Final Overtime Rules


Please join us on Thursday, October 27th for our next event: “Ready or Not:  What you Need to Know About the U.S. DOL’s Final Overtime Rules”.  The U.S. Department of Labor’s revisions to the “white collar” overtime exemptions go into effect on December 1, 2016. 

We will have a panel of experts – including representatives from the U.S. Department of Labor and experienced members of the local HR community – answer your questions, provide practical advice for complying with the new rules, discuss proactive risk management strategies, offer best practices for transitioning and communicating changes with your employees and review what we can expect to result from recent lawsuits challenging the new rules.
 
The event will be held at the Syracuse Doubletree Hotel, 6301 State Route 298, East Syracuse from 8 am – 10:30 am.

Question:  I’ve heard about the new regulations on payroll debit cards; do they also impact employers who pay employees by direct deposit?


Answer:
 Yes. On September 7, 2016, the New York State Department of Labor adopted final regulations establishing conditions by which employers can pay wages to employees by any method other than cash or check, which includes direct deposit and payroll debit cards.  Although most of the more onerous requirements regulate the payment of wages by payroll debit cards, the regulations also impose new notice and consent requirements for paying employees by direct deposit.


Effective March 7, 2017, employers using direct deposit must provide employees with prior written notice which must include:

  1. A plain language description of all the employee’s options for receiving wages;
  2. A statement that the employer may not require the employee to accept wages by payroll debit card or direct deposit;
  3. A statement that the employee may not be charged any fees for services necessary to access his/her wages; and
  4. If offering an option to receive wages by payroll debit card, additional information, including a list of locations where wages can be withdrawn.

Employers must also secure employees’ advance, written consent following receipt of such notice. The written notice and consent must be provided in English and in the primary language of the employee; the Department of Labor intends to provide templates.  A copy of the consent must be provided to the employee and a copy must be retained by the employer during the employee’s employment and for six (6) years following the last payment by direct deposit.


These new requirements do not apply to bona fide executive, administrative, or professional employees who earn more than $900 per week, or employees on a farm not in connection with a factory.  The Department of Labor has also clarified that direct deposit authorizations obtained from employees prior to the effective date of the new rule will remain valid if employees are provided with notices that comply with the new regulations.  This is a reversal of its prior position taken earlier this year which would have invalidated all prior direct deposit authorizations.

Salary Survey Debrief

 
On August 18 CNY SHRM held its annual Salary Survey Debrief Session.  Jennifer Loftus from Astron Solutions delivered the presentation and covered not only the survey results, but an excellent overview of upcoming compensation challenges. 

 

We had over 40 participants at the event.  One of the most interesting pieces of Jennifer’s annual overview is her overview of the general hiring, unemployment and compensation trends. This year she discussed the NY State minimum wage change and what we can expect over the next several years.  Next she covered the survey participants and we have had a very stable participation for some key companies over the last several years. This ensures a consistency of our data. The industries represented are a good cross section of for profit and not-for-profit.  She also reviewed a few of the jobs in the survey and provided some year over year analysis. To finish up, she highlighted some of the benefits data from the survey.  It was an excellent overview of the survey and a very informative session.
 
Recommendation:  If you have not attended one of the debrief sessions, be sure to put it on your calendar for 2017.  Jennifer will be back on August 17, 2017.
