Defending Against Whistleblower and Retaliation Claims: The 10 Things You Never Want to Have to Admit

Retaliation claims are the fastest growing type of claims and, for a number of reasons, are likely to continue to increase. Mr. DiLorenzo’s talk will update attendees on the status of the law in this area, including a new U.S. Supreme Court decision expected this term, and the practical ways to avoid and deal with such claims from a Human Resources perspective. Included in that advice will be avoiding the 10 things you never want have to admit to doing in one of these cases.  This list has been developed as a result of the many hours he has spent preparing human resources professionals to testify and watching them withstand cross examination and after-the-fact scrutiny and second-guessing by plaintiff’s lawyers, juries and judges.

Biography:

Louis P. DiLorenzo is the Chair of Bond, Schoeneck & King, PLLC’s Labor and Employment, Employee Benefits and Immigration Practice Group – one of the largest Practice Groups in the Firm. The New York Law Journal recently published the results of a study that shows this Practice Group defends more Employment Discrimination claims in the Federal District Courts for the Northern and Western Districts of New York than any other firm. The Northern and Western Districts of New York include 49 of the 62 counties in New York, from Buffalo to Albany and from the lower Hudson Valley to the Canadian border.
